Terms of Service

1. Acceptance of Terms

By creating an account and using Mzigotogo, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use Mzigotogo. By using our services, you represent and warrant that you meet these requirements.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. User Roles

Truck Owners: Users who own or operate trucks and accept load delivery jobs.

Load Owners: Users who need to transport goods and post load requirements.

Both parties agree to conduct business professionally and in good faith.

5. KYC Verification

• All users must complete KYC (Know Your Customer) verification
• Required documents include: National ID, Driver's License, Business Permit, Tax Certificate, Insurance Certificate, and Vehicle Logbook
• Verification typically takes 1-2 business days
• We reserve the right to reject applications that don't meet our standards
• Providing false information may result in account termination

6. Subscriptions and Payments

• Subscription plans: Daily (KES 20/day) or Monthly (KES 500/month)
• Subscriptions auto-renew unless cancelled
• All payments are processed through M-Pesa
• Refunds are subject to our refund policy
• We reserve the right to change subscription prices with 30 days notice
• Failure to maintain an active subscription limits platform access

7. Platform Usage

You agree NOT to:

• Post false or misleading information
• Engage in fraudulent activities
• Harass or abuse other users
• Violate any applicable laws or regulations
• Attempt to hack or disrupt the platform
• Use the platform for illegal purposes
• Share your account with others
• Scrape or collect data from the platform

8. Bookings and Transactions

• All bookings are binding agreements between users
• Payments are held in escrow until delivery confirmation
• Disputes must be reported within 48 hours of delivery
• We act as a facilitator and are not party to user agreements
• Users are responsible for their own insurance and liability
• Cancellation policies apply as per booking terms

9. Service Fees

• Mzigotogo charges a service fee on completed transactions
• M-Pesa transaction fees apply to all payments
• Fees are clearly displayed before transaction confirmation
• We reserve the right to modify fee structures with notice

10. Intellectual Property

All content, trademarks, and intellectual property on Mzigotogo are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Limitation of Liability

Mzigotogo is provided "as is" without warranties of any kind. We are not liable for:

• Damages arising from platform use or inability to use
• Loss of data, profits, or business opportunities
• Actions or omissions of other users
• Delays, interruptions, or errors in service
• Third-party services (M-Pesa, GPS, etc.)

12. Indemnification

You agree to indemnify and hold Mzigotogo harmless from any claims, damages, or expenses arising from your use of the platform, violation of these terms, or infringement of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Abuse of the platform or other users
• Any reason we deem necessary to protect our platform

14. Dispute Resolution

• Disputes between users should be resolved amicably
• We provide mediation services for transaction disputes
• Unresolved disputes may be subject to arbitration
• Kenyan law governs these terms and any disputes

15. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of the platform after changes constitutes acceptance of the new terms.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
